Disability Retirement
An injured officer or firefighter that is permanently incapacitated from duty may be eligible for an industrial disability retirement that on average constitutes a fifty-percent of salary, tax free for life benefit. We have successfully presented claims before PERS and County retirement boards. When faced with disability retirement, a public safety officer must file the application within a specific time period and provide the medical evidence supporting the disability and the incapacity to perform the duties. It is imperative that the public safety member seeks counsel and advice on this process to ensure retirement is duly granted.
