Q:    In contract negotiations, how should an association go about analyzing whether a salary increase is justified?
A:    To determine if there are salary differences, the association will need to request the financial books from the city or county and then conduct a salary survey involving like agencies by an actuary or accountant.  A thorough salary survey can be the difference in obtaining a raise.

 

Q: In an internal affairs investigation should an officer volunteer information to investigators?
 A:   Absolutely not. Any statements you make to investigators should only be in response to an order from your superior. Coerced statements that are obtained under a Lybarger order cannot be used in any subsequent criminal proceeding.

 

Q:      When should you file a workers’ compensation claim?
A:      A report of injury should be submitted if the injury has caused a need for medical treatment beyond basic first aid. The longer the injury goes un-reported, the greater the likelihood that the insurance company may deny or delay the claim. The details of the injury need to be accurately stated.

 

Q:      Can I seek benefits from my insurance when a driver who is at fault in a MVA is uninsured or does not have enough insurance?
A:      Yes. Your insurance policy under uninsured motorist/underinsured motorist (UM/UIM) has the stated coverage and will activate to compensate you when the errant driver does not have adequate insurance. It is very important to look at your coverage for UM/UIM and increase your policy.
